It doesn't matter how much you own, without a Will you lose the right to say what should happen to your property after your death; instead the law will decide and the outcome may not be what you would have wished or imagined. We increasingly take out insurance for every eventuality but ensuring your family is provided for through your Will (both materially and in practical terms, for example, the appointment of guardians for minor children) is all too often overlooked. Having an appropriate Will in place gives peace of mind and can avoid undue delay or expense when it comes to carrying out your wishes.

Our experienced solicitors from the Wills and Estates Team offer an Executor service, this will save your loved ones from having to carry out this role at a highly sensitive time. You simply need to appoint them on drafting your will.

It is also a good idea to think about who you would wish to manage your financial affairs whilst you are living should you ever be unable to do so yourself. This is not just for mental incapacity, but also should you be physically unable to deal with your affairs through illness or following an accident. You can appoint the person of your choice using a Lasting Power of Attorney and this can take effect straight away or only when you are incapable of dealing with your affairs for whatever reason.

The alternative process for individuals without a Lasting Power of Attorney who become incapable is the appointment of a Deputy through the Court of Protection which is a lengthy and costly process and may result in a person not of your choice managing your affairs.
